DONNELLY ANNOUNCES SEX OFFENDER INDICTMENTS

Troy, NY – Rensselaer County District Attorney Mary Pat Donnelly announced today that the following have been indicted by a Rensselaer County Grand Jury:

David Hall, age 40 of Troy, NY, was indicted on two counts of Failure to Register or Verify as a Sex Offender, both are Class D Felonies. It is charged that the defendant, in November 2019, being a registered sex offender as defined in Section 168-a of the Corrections Law, and being required to register with the Division of Criminal Justice Services no later than within twenty days of his third anniversary to appear and provide a current photograph did fail to personally appear at the Troy Police Department for the purpose of providing a current photograph and being required to register with the Division of Criminal Justice Services no later than ten calendar days after any change of address, did change his address and fail to register with the Division of Criminal Justice Services within ten calendar days. The defendant was previously convicted of a Sex Offender Registry violation before the Hon. Thomas A. Breslin in 2009. The defendant is scheduled to be arraigned before the Hon. Debra Young on October 26, 2020.

Debra Menhart, age 66 of Troy, NY, was indicted on one count of Failure to Register or Verify as a Sex Offender, a Class D Felony. It is charged that the defendant, in the month of May, 2020, being a sex offender as defined in Section 168-a of the Corrections Law, and being required to register with the Division of Criminal Justice Services no later than ten calendar days after any change of address, did change her address and fail to register with the Division of Criminal Justice Services within ten calendar days of that change of address. The defendant was previously convicted of Failure to Register or Verify an Address as a Sex Offender in the Warrant County Court before the Hon. John S. Hall, Jr. in June 2012. The defendant is scheduled to be arraigned before the Hon. Jennifer G. Sober on Friday, October 23, 2020.

Scott Lovelace, age 53 of Troy, NY, was indicted on one count of Failure to Register or Verify as a Sex Offender, a Class E Felony. It is charged that the defendant, in the month of August, 2020, being a sex offender as defined in Section 168-a of the Corrections Law, and being required to register with the Division of Criminal Justice Services no later than ten calendar days after any change of address, did change his address and fail to register with the Division of Criminal Justice Services within ten calendar days of that change of address. The defendant was arraigned before the Hon. Debra Young and ordered to wear an electronic monitoring device.

Kevin McCarthy, age 31 of North Greenbush, New York, waived indictment and entered a plea of guilty before the Hon. Jennifer G. Sober, to a Superior Court charging him with the crime of Criminal Sex Act in the Second Degree, in violation of Sections 130.45(2) of the Penal Law of the State of New York, a Class D Felony. The defendant admitted that between January 1, 2018 and December 31, 2018 being over 18 and an Assistant Manager for the Rensselaer County ARC, did engage in oral sexual conduct with a person who is incapable of consent by reason of being mentally disabled in that the individual suffers from Downs Syndrome, and is declared mentally incapacitated by law. Defendant agreed as part of the plea agreement to register as a Sex Offender. Sentencing has been adjourned until December 22, 2020. “We need to protect those who are helpless, not hurt them. Through the investigative efforts of the North Greenbush Police Department and the Justice Center the defendant was brought to justice. Today he was held accountable for his predatory acts,” District Attorney Mary Pat Donnelly said.
