Article I
The duties and functions of the Board of Health of Rensselaer County as outlined
in the Public Health Law of the State of New York are primarily directed to the
formulation, promulgation, adoption and publication of the rules, regulations,
orders and directions for the security of life and health, and the enforcement
of the sanitary code in the health district.
Article II
The Rensselaer County Board of Health shall consist of nine members appointed
in accordance with the provisions of section 20B, Article III of the Public Health
Law of the State of New York.
Article III
Conduct of business and affairs of the Rensselaer County Board of Health shall
be pursued in accordance with the statutes of the State of New York and the State
Sanitary Code.
Article IV
The Board of Health shall elect at its October annual meeting one of its members
as President and another as Vice President. The Board may designate the secretary.
Article V
In the absence of the President, the Vice-President shall preside. In the absence
of both the President and the Vice President, the Board shall elect one of its
members to preside as Chairman.
Article VI
The order of business shall be roll call, reading and approval of the minutes
of the previous meeting, report of the Public Health Director, report of the
chairman of Standing Committees, report of the Chairman of Special Committees,
unfinished business, new business.
Article VII
A quorum for the transaction of official business shall be five (5) members of
the Board. Resolutions shall be passed by a majority vote of those present. Minutes
of each meeting shall be typed and a copy furnished to each member prior to the
next monthly meeting.
Article VIII
Necessary absence of any member from a regular or special meeting shall be communicated
to the Secretary or Commissioner of Health prior to the meeting.
Continued absence of any member from three (3) consecutive meetings without a
valid excuse shall be placed before the Board for consideration.
Article IX
In an emergency, such as an outbreak of epidemic disease or disaster, the President
or in his absence, the Vice-President, may act for the Board upon the written
recommendations of the Public Health Director.
In the absence of the President, and the Vice President two (2) members of the
Board may act for the Board in the event of one of the aforesaid emergencies.
Article X
There shall not be less than ten(10) regular monthly meetings of the Board each
year.
Special meetings of the Board may be called by the President by giving notice
thereof to each member not less than twenty four hours before the time of such
a meeting. In the absence of the President and the Vice President a special meeting
may be called by the Public Health Director.
Article XI
The report of Public Health Director shall be presented at each meeting. Such
report upon arrival by the Board shall be included in the minutes.
Article XII
The President shall appoint standing committees as may be authorized by the Board.
(Education, Inspection, Special Projects, etc.)
Article XIII
Standing Committees shall be appointed for regular visitation and inspection
at the Health Department, County Laboratory and all County Health Facilities.
A report of such inspection and examination shall be made at the next Board meeting
by the Chairman of the respective committee.
Article XIV
Subject to the provisions of the State Law and the regulations and resolutions
of the Rensselaer County Legislature, the Board shall determine in what manner
expenditures may be made by the Department of Health, the Public Health Director
and the County Laboratory.
Article XV
The By-laws may be rescinded, altered or amended at the October annual meeting
by the affirmative vote of two thirds of the members of the Board actually present.
Due notice of this proposed action shall be duly given to the members with the
notice of such meeting.
