Rensselaer County District Attorney Joel E. Abelove announced that on Tuesday, September 27, 2016, Heather Smith, a/k/a Heather Davis, age 37, of St. Ann, Missouri, pled guilty to one count of Criminal Sexual Act in the Third Degree, a class E felony. The defendant formerly resided in Troy during the commission of the offenses contained in the indictment.
The defendant faced 10 charges relating to various instances of sexual abuse of a minor by way of a sealed indictment. This case was investigated by Troy Police and the START Children’s Center, as well as Rensselaer County Child Protective Services. Prior to her arrest on these charges, the defendant fled to Missouri, and was returned to Rensselaer County following the issuance of a Governor’s Warrant.
Last Friday, Smith’s husband and co-defendant, Robert Smith, pled guilty to Attempted Rape in the First Degree, and will receive four (4) years of state prison, to be followed by twelve (12) years of post-release supervision.
Pursuant to the terms of Heather Smith’s plea agreement, she will be sentenced to a period of time served in the Rensselear County Jail and ten (10) years of felony probation. She will also be required to register as a sex offender. The defendant is scheduled to be sentenced on October 18, 2016, at the Rensselaer County Courthouse and will be held before the Honorable Debra J. Young.
Abelove said, “This woman’s complicity in her husband’s conduct is disgusting and reprehensible. Fortunately, the young victim in this case has been spared the additional trauma of having to testify in court. Our heartfelt prayers go out to her, and we hope that this resolution will help her heal and move on with her life in a positive way. ”
