Rensselaer County District Attorney Joel E. Abelove announced today that Xavier T. Hilton, age 22, was convicted by a jury of one (1) count of Criminal Possession of a Weapon in the Second Degree, a class C felony and one (1) count of Criminal Possession of a Firearm, a class E felony. The verdict came today following a three day trial in Rensselaer County Court.

The defendant was spotted on April 7, 2016, in the area of Middleburgh Street and 6th Avenue, after a member of the Troy Police Department recalled seeing the defendant’s picture in a law enforcement advisory from the Albany Crime Analysis Center. Upon being approached by the officer, Hilton fled on foot and was seen throwing a handgun over a fence. The officer was able to apprehend Hilton and a loaded handgun was subsequently recovered during the investigation.

As a result of the conviction, the defendant faces up to fifteen (15) years in state prison and five (5) years post-release supervision. The defendant will be sentenced on Thursday, November 3, 2016, at the Rensselaer County Courthouse, before the Honorable Andrew G. Ceresia.

Abelove said, “I’d like to thank the jury for their swift and just verdict in this case. Violent criminals belong off our streets, and thankfully this defendant will spend many years in prison where he belongs. Thankfully, the brave members of the Troy Police were able to identify and capture Mr. Hilton without injury.”
