Rensselaer County District Attorney Joel E. Abelove announced that David H. Dugan, age 32, of Hoosick Falls, NY, was sentenced to state prison today for his guilty plea to one (1) count of Driving While Intoxicated, a class D felony and one (1) count of Violation of Probation (VOP), for a previous DWI-related conviction.

On February 24, 2017, the defendant pled guilty to the class E felony, Driving While Intoxicated, resulting in a sentence of probation. In the early morning hours of February 25, 2017, Dugan was pulled over for a traffic violation in the Village of Hoosick Falls. When stopped by members of the Hoosick Falls Police Department, Dugan failed several field sobriety tests, and had a blood alcohol content of .17%.

As a result of the plea, the defendant was sentenced to one and one-half (1 ½) to four and one-half (4 ½) years in state prison along with the revocation of his driver’s license. He was also sentenced to one and one-third (1 1/3) to four (4) years in state prison for his Violation of Probation (VOP), to be served concurrently. The defendant was sentenced today, at the Rensselaer County Courthouse before the Honorable Debra J. Young.

Abelove said, “This defendant displayed a blatant disregard for the safety of everyone on the road. The fact that he chose to drink and drive within hours of being sentenced for drunk driving is almost shocking. Now that he has been sentenced to state prison, he won’t have the chance to reoffend for some period of time.”

Assistant District Attorney Renée Behrens prosecuted the case.
