Rensselaer County District Attorney Joel E. Abelove announced today that Xavier T. Hilton, age 22, was sentenced to thirteen (13) years in state prison and five (5) years post release supervision, before Honorable Andrew G. Ceresia in Rensselaer County Court.

On September 28, 2016, a jury found Hilton guilty of one (1) count of Criminal Possession of a Weapon in the Second Degree, a class C felony and one (1) count of Criminal Possession of a Firearm, a class E felony. The jury rendered its guilty verdict following a three-day trial in Rensselaer County Court.

The defendant was spotted on April 7, 2016, in the area of Middleburgh Street and 6th Avenue, after a member of the Troy Police Department recalled seeing the defendant’s picture in a law enforcement advisory from the Albany Crime Analysis Center. Upon being approached by the officer, Hilton fled on foot and was seen throwing a handgun over a fence. The officer was able to apprehend Hilton and a loaded handgun was subsequently recovered during the investigation.

Abelove said, “Criminals who possess illegal firearms will be dealt with severely. This defendant’s long criminal history demanded a lengthy prison term. The Troy Police did a great job taking this felon off our streets.”

Assistant District Attorney Andrew T. Botts prosecuted this case.
